Mandatory minimum sentences have been declared unconstitutional in most counties in Pennsylvania including Bucks, Montgomery and Philadelphia Counties. However, judges are still mindful of the quantity of drugs involved and prior drug convictions in sentencing which factors can aggravate a sentence.
