Multi-DUI offenders may avoid jail and continue working with house arrest
Those charged with a second or third DUI within ten years are subject to an enhanced jail sentence. Depending on the county, if approved by the sentencing judge, it may be possible to serve the jail sentence under house arrest. As the name suggests, house arrest requires that you remain at your home during your confinement period, but it is possible to obtain permission to go to and from work, school and counseling while under house arrest. Application for house arrest should be made before sentencing and the sooner the better as this could decrease the likelihood of having to wait in jail after conviction while your application for house arrest is being reviewed. The likelihood of being approved for house arrest is also increased if you receive some form of intensive alcohol treatment as soon as possible after being charged with a DUI.
