Marijuana Possession – Avoiding a Conviction
Recreational use is not Legal Yet, but now it is possible to avoid a drug conviction before the case goes to court. There are now two new ways that keep the case at the District Court and result in dismissal and expungement of the charges:
CAP – Community Accountability Program is for a person with no criminal history and a summary or marijuana charge.
DCDP – District Court Diversionary Program is for a Bucks County resident with a marijuana charge even if they have prior such offenses. It calls for an assessment, treatment and a status hearing.
The old methods of avoiding a drug conviction are available as well:
– Trial and acquittal
– Negotiate – lesser offense
– Section 17 Probation/dismissal for drug users
– ARD Probation/dismissal for first offenders
